Village Board Meeting Minutes
October 2, 2007

The Village of Caledonia Board of Trustees held a meeting on Tuesday, October 2, 2007, at 6:00 p.m. at the Village Office.

Members Present: Mayor Joe Caluorie, Deputy-Mayor Teresa Truman, Trustees Steve Boscoe, Diane Fowler and Steve Polo. Also present: Jeff D’Angelo of Underberg & Kessler, LLP.

A motion was made by Trustee Boscoe to approve the September 18th and October 1st, 2007 Board Meeting Minutes; Deputy-Mayor Truman seconded the motion.

A motion was made by Deputy-Mayor Truman to approve the bills paid; Trustee Polo seconded the motion.

Clerk-Treasurer Ann Marie Grattan stated that due to the amendment in November of 2006 to §192-17 and §192-23 of the Code of the Village of Caledonia, no motion is needed to approve the limits. The local law states: "the schedule of income limits and exemption percentages to be applied to real property owned by eligible persons shall be the same schedule as that adopted each year by the County of Livingston." A copy of the local laws will be forwarded to the Town of Caledonia and Livingston County.

Clerk-Treasurer Report for the month of September was presented by Ann Marie Grattan. General revenues for the month totaled $104,663.57. A CHIPS payment of $56,103.21 was received for New York State reimbursement of road projects. The State also paid a claim in the amount of $5,079.64 for village work on North Street in 1994. Thirty-seven property taxes remained unpaid on October 1st and were returned to the County in the amount of $46,486.13. Water invoices were mailed and outstanding water rents receivable is $60,899.03. Total water and general expenses were down $72,698.51 from August. Total water and general revenues were up $67,184 from August. Recreation, DPW and Police payroll and contractual budget sheets were submitted to the Department Supervisors. A motion was made by Trustee Boscoe to accept the report; Trustee Fowler seconded the motion.

CEO Report for the month of September was presented verbally by Mayor Caluorie. A property on Main Street is a public hazard. The Village Board would like Village Attorney Jim Coniglio to prepare a letter; which will start the process of having the property boarded or cleaned up. A property on Church Street has received numerous violations and CEO Tom Perkins is currently working with the resident to resolve the issues. The Alhart Funeral Home has submitted a variance; which has not been acted upon yet by the Zoning Board of Appeals. The Village Board would like Village Attorney Jim Coniglio to prepare a letter with his legal opinion. The Board would like the ZBA notified as to whether a 60-day timeframe has elapsed or should the ZBA schedule a Public Hearing for Mr. Deragon. A property on Main Street is using part of their front yard as a mini-parking lot. Attorney Jeff D’Angelo stated that the property owner should file an application with the State for a permit for a driveway. A motion was made by Trustee Boscoe to accept the verbal report; Deputy-Mayor Truman seconded the motion.

DPW Report for the month of September was presented by Chris Buckley. Water meters were read in September and the Graney Road water tank is back on line. Sidewalks have been completed on Iroquois Road, Church and Main Streets. Mowing continues and fall banners were hung in the business district. Repairs were made to the monument lights and the village boiler. Mr. Buckley presented the Village Board with a planned maintenance agreement from ISAAC HVAC. A motion was made by Trustee Fowler to accept the report; Deputy-Mayor Truman seconded the motion.

Police Report for the month of September was submitted by David Richardson. There were 340 village service calls and 3 for the town. There were four domestic incidents, five fingerprint sets, 30 traffic tickets, three motor-vehicle accidents, 11 ambulance calls, seven burglar alarms, one assist to the Fire Department and sixteen arrests. Activities include CMCS Resource Officer, court appearance, foot patrol to parks and the business district and monitoring of the traffic circle. A motion was made by Trustee Polo to accept the report; Trustee Boscoe seconded the motion.

West Main Street Drainage Easements – Mayor Caluorie stated he checked with Town Superintendent Mark Schroeder the status of the project and JCI signed the easement paperwork. Signatures are still pending from the Bean Plant (John McCreedy) and CRC (Les Cole). Mr. Caluorie would like to finalize this project as soon as possible and asked Jeff D’Angelo to follow-up with Jim Coniglio on the signatures.

Court – Judge Riggi expressed with regret with the resignation/retirement of Court Clerk Barb Keenan. Judge Riggi stated that Mrs. Keenan has been a great asset to the village and town court for the past 15 years and will be truly missed. Judge Riggi discussed how he would like to proceed with hiring a clerk for approximately 30 hours per week.

Mayor Caluorie read Barb Keenan’s letter or retirement/resignation as Village Court Clerk. A motion was made by Deputy-Mayor Truman to accept it; Trustee Fowler seconded the motion.

Election Certification: Clerk-Treasurer Ann Marie Grattan stated that Section 4-1-6 of the New York State Election Law requires each Village Clerk, to make and transmit to the Board of Elections, a certificate stating every village office to be voted on March 18, 2008:

WHEREAS, the next general Village Election for officers will be held on March 18, 2008 and

NOW, THEREFORE, BE IT RESOLVED: that the Board of Trustees designated the following offices as vacant at the end of the current official year, to be filled at the Village election to be held on March 18, 2008 for the following terms:

  • TRUSTEE FOUR (4) Years
  • TRUSTEE FOUR (4) Years
  • JUSTICE FOUR (4) Years

A motion was made by Deputy-Mayor Truman to accept the certificate stating all village offices to be voted on March 18, 2008; Trustee Boscoe seconded the motion.

Workplace Violence Protection Act – Mayor Caluorie stated that Officer David Richardson and himself are currently working on this project.

Water Supply – the Tuesday, October 16th Board Meeting will be strictly regarding the water supply. Chatfield Engineers, the County Health Department and a hyrdo-geologist are invited to attend to answer additional questions the Village Board may have.

Deputy-Mayor Truman discussed with the Village Board $2,000 worth of inflatable toys in the 2008 Youth Budget. Mrs. Truman stated that S&S Limousine previously quoted $500 to a Recreation Board Member and she feels that the village could save money by going with a lower quote. Mrs. Truman said the $500 quote includes two blow-up bouncy toys, a popcorn or snow cone machine. A motion was made by Deputy-Mayor Truman to amend the 2008 Youth Budget for this item from $2,000 down to $500. No second motions were made. Trustee Boscoe asked that it first be verified that the products of the $500 quote are exactly what the Recreation Department needs. Trustee Polo also stated that we have to be sure we are comparing apples to apples. Trustee Polo, as Liaison to the Recreation Board, will further investigate the matter.

Executive Session: a motion was made at 7:34 p.m. by Trustee Boscoe to enter into executive session to discuss legal issues; Trustee Fowler seconded the motion.

After some discussion, Deputy-Mayor Truman made a motion at 7:50 p.m. to close the executive session.

Village Board Meeting Minutes
October 1, 2007
Special Meeting

The Village of Caledonia Board of Trustees held a special meeting on Monday, October 1, 2007, at 4:00 p.m. at the Village Office.

Members Present: Mayor Joe Caluorie, Deputy-Mayor Teresa Truman and Trustee Steve Boscoe. Absent: Trustee Diane Fowler and Steve Polo.

Tax Resolution: Deputy-Mayor Truman, with Trustee Boscoe moving for adoption offered the following resolution:

NOW, THEREFORE, pursuant to Section 1442 of the New York State Real Property Tax Law, be it resolved that the Village of Caledonia requests collection of certain delinquent Village Taxes by the County of Livingston.

AYE: Mayor Caluorie, Deputy-Mayor Truman and Trustees Boscoe. NAY: None

The resolution was unanimously adopted and must be filed with the Livingston County Treasurer and the Clerk of the Livingston County Board of Supervisors by October 5, 2007.

Unpaid taxes for 2007-2008 amount to $46,486.13.

There being no further business, a motion was made by Trustee Boscoe to adjourn at 4:05 p.m.; Deputy-Mayor Truman seconded the motion.
