Village Board Meeting Minutes
July 12, 2007

The Village of Caledonia Board of Trustees held a special meeting on Thursday, July 12, 2007, at 1:00 p.m. at the Village Office.

Members Present: Mayor Joe Caluorie, Deputy-Mayor Teresa Truman and Trustee Steve Polo. Absent: Trustee Diane Fowler and Steve Boscoe.

A motion was made by Deputy-Mayor Truman to hire Diane Carson as Lifeguard for $1,440 yearly salary; Trustee Polo seconded the motion.

AYE: Mayor Caluorie, Deputy-Mayor Truman and Trustee Steve Polo. NAY: None

A motion was made by Deputy-Mayor Truman to hire Kirsten Vallone as Lifeguard for $10.00 per hour; Trustee Polo seconded the motion.

AYE: Mayor Caluorie, Deputy-Mayor Truman and Trustee Steve Polo. NAY: None

Release and Indemnification: Resolution was offered by Trustee Polo with Deputy-Mayor Truman moving for adoption:

WHEREAS, the Village of Caledonia (the "Village") conducts a summer swimming program in connection with it summer youth recreation program, and

WHEREAS, the Village neither owns nor operates swimming facilities of any kind, and

WHEREAS, the Village conducts its swimming program at a privately owned swimming pool on private property owned by Ivan and Diana Carson (the "Owners") at 344 Middle Road, Caledonia, New York, and

WHEREAS, in consideration for the permission granted by the owners to the Village for such use of the Owner’s property the Village agrees to indemnify and hold the Owners harmless from any claim or loss arising from the use by the Village of the Owners’ property.

IT IS HEREBY AGREED AS FOLLOWS:

1. The Village agrees that the Owners shall not be liable for and agrees to defend, indemnify, release and hold the Owners harmless from and against any and all (i) liability for loss or damage to property or injury to or death of any and all Persons that may be occasioned by reason of or in connection with the occupation or the use of the Owners’ property by the Village, it’s authorized agents or the presence of any person or property on, in or about such property, duly authorized by the Village connection with the Village summer recreation swimming program

2. Without limiting the generality of the foregoing, this indemnification and hold harmless provision shall extend to cover any expenses incurred in defending any claims, suits or actions that may arise as a result of any of the foregoing provided that any such losses, damages, liabilities or expenses of the Owners are not incurred or do not result from the gross negligence or intentional or willful wrongdoing of the Owners or their authorized agents.

The foregoing indemnities shall apply notwithstanding the ordinary fault or negligence in part of the Owners or the application of any rule of comparative or apportioned liability. The foregoing indemnities are limited only to the extent of any prohibitions imposed by law.

There being no further business, a motion was made by Deputy-Mayor Truman at 1:20 p.m. to adjourn; Trustee Polo seconded the motion.

Village Board Meeting Minutes
July 11, 2007

The Village of Caledonia Board of Trustees held a special meeting on Wednesday, July 11, 2007, at 1:00 p.m. at the Village Office.

Members Present: Mayor Joe Caluorie, Deputy-Mayor Teresa Truman and Trustee Steve Polo. Absent: Trustee Diane Fowler and Steve Boscoe.

A motion was made by Deputy-Mayor Truman to approve Dennis Nothnagle and Steve Wilson to attend a NYCOM Planning and Zoning summer session on July 26th at SUNY Geneseo. The cost is $60 each. Trustee Polo seconded the motion.

AYE: Mayor Caluorie, Deputy-Mayor Truman and Trustee Steve Polo. NAY: None

A motion was made by Deputy-Mayor Truman to approve Mayor Caluorie to sign a New Duties Statement to create two new lifeguard positions; Trustee Polo seconded the motion.

A motion was made by Trustee Polo at 1:30 p.m. to adjourn; Deputy-Mayor Truman seconded the motion.

Village Board Meeting Minutes
July 3, 2007

The Village of Caledonia Board of Trustees held a meeting on Tuesday, July 3, 2007, at 4:00 p.m. at the Village Office.

Members Present: Mayor Joe Caluorie, Deputy-Mayor Teresa Truman, Trustees Steve Boscoe and Steve Polo. Absent: Trustee Diane Fowler. Also present: Village Attorney Jim Coniglio.

A motion was made by Trustee Boscoe to approve the June 19, 2007 Board Meeting Minutes; Trustee Polo seconded the motion.

AYE: Mayor Caluorie, Deputy-Mayor Truman, Trustees Boscoe and Polo. NAY: None

Bills were audited and ordered paid:

  • Abstract #249, Vouchers 6780-21
  • General $52,209.78
  • Water $ 2,061.96
  • Abstract #132, Vouchers 6822-24
  • Water $ 192.83

A motion was made by Deputy-Mayor Truman to approve the bills paid; Trustee Boscoe seconded the motion.

State of New York Unified Court System Audit – Trustee Steve Boscoe has audited the financial records of the village court system. Deputy-Mayor Teresa Truman has audited the village court dockets. A motion was made by Trustee Boscoe to approve a letter be sent to the State of New York Unified Court System approving the recent internal audit; Deputy-Mayor Truman seconded the motion. Mayor Caluorie, Deputy-Mayor Truman and Trustee Boscoe all signed the letter. Also mailed was a copy of the 2002 audit performed by Gray CPA.

A motion was made by Trustee Boscoe to waive the $15.00 late fee for parking ticket #789; Trustee Polo seconded the motion.

A motion was made by Deputy-Mayor Truman to reimburse M&T Bank $966.52 and Marine Midland Bank $790.61 for escrow payments previously made by other financial lenders; Trustee Polo seconded the motion.

Discussion regarding a variance received from Jeff Deragon for a parking lot at the Alhart Funeral Home located at 3064 Main Street. Mr. Allen Roggen, Chairperson for the Zoning Board of Appeals, must recue from discussions regarding the variance. It is of the legal opinion of Mr. Coniglio that Mr. Roggen not be involved in any of the process. Mr. Roggen is entitled to a copy of the paperwork under the Freedom of Information Act, but Acting-Chairperson Ron Grant must review the paperwork, prepare legal notices, etc. Mr. Roggen must withdrawal from every process involved with the variance.

DPW, Clerk-Treasurer and CEO reports for June have been tabled.

Discussion regarding 3055 Main Street. Ms. Laura Kelley filed a complaint that the property is in violation of village code. The property is in foreclosure status and a new owner is in the process of closing on the property. Mr. Congilio’s legal opinion is that approximately five weeks should be allowed to fix the property violations. Code Enforcement Officer Tom Perkins is currently working with the bank on the issue. Mayor Caluorie will contact Ms. Kelley with an update.

Workplace Violence Prevention Act – tabled.

A motion was made by Trustee Polo to approve the Cal-Mum Girls Softball team a car wash on Saturday, August 18th from 8:45 a.m. until 1 p.m. at the commons parking lot; Deputy-Mayor Truman seconded the motion.

AYE: Mayor Caluorie, Deputy-Mayor Truman, Trustees Boscoe and Polo. NAY: None

Discussion regarding the upcoming garbage and recycle contract. Mr. Coniglio is going to prepare a letter for Mayor Caluorie; which will be an invitation to bid on the contract.

Executive Session: a motion was made by Trustee Polo at 4:42 p.m. to enter into executive session for personnel discussions; Deputy-Mayor Truman seconded the motion.

AYE: Mayor Caluorie, Deputy-Mayor Truman, Trustees Boscoe and Polo. NAY: None

After some discussion, Trustee Boscoe made a motion at 5:05 p.m. to close the executive session; Deputy-Mayor Truman seconded the motion.

There being no further business, a motion was made at 5:05 p.m. by Deputy-Mayor Truman to adjourn; Trustee Boscoe seconded the motion.
