A regular meeting of the Town Board of the Town of Caledonia was held Thursday, October 18, 2007 at 7:00 P.M. at the Town Hall.

Supervisor Pangrazio called the meeting to order at 7:00 P.M. and led in the Pledge of Allegiance.

RESOLUTION 106-2007
APPROVAL OF SEPTEMBER 13, 2007 MINUTES

On motion of Councilman Rothrock, seconded by Councilman Bickford, the following resolution was

RESOLVED, that the minutes of September 13, 2007 be approved as presented.

RESOLUTION 107-2007
APPROVAL OF SEPTEMBER 25, 2007 MINUTES

On motion of Councilwoman Rychlicki, seconded by Councilman Anderson, the following resolution was

RESOLVED, that the minutes of September 25, 2007 be approved as presented.

OPEN FORUM

  • No one was present to speak.

ANNOUNCEMENT/COMMUNICATIONS

  • The Town Board received Thank you cards from Kevin Quinlan and Kathy Sawyer.
  • Supervisor Pangrazio gave the Board copies of the 2006 & 2007 Town Salaries for Livingston County.
  • Supervisor Pangrazio received a letter from Mark Noetzel, CEO and President of Cilion, Inc. on the Caledonia Ethanol Project. At the present time they have temporarily put on hold the permitting of the ethanol plant.
  • The Fall Local Gov’t workshop will be held this fall for training for Planning and Zoning Board members.
  • Supervisor Pangrazio received a letter from David Becker for a business venture called Sunshine Karting on River Road. Sunshine Karting will be recycling yard waste along with manure to produce humidified compost.
  • Supervisor Pangrazio and the Board received a letter from Kevin Quinlan thanking them for his reappointment as Town Assessor and all of their support through the revaluation project.
  • Supervisor Pangrazio received a report from Barry Ganzhorn concerning the state of the wildlife population.

DEPARTMENTS & COMMITTEES

ATTORNEY

  • Attorney Skivington is currently working on several items for the Town

PLANNING BOARD

  • Councilman Anderson reported on the most recent Planning Board meeting and items placed on the October 24, 2007 agenda.

CODE ENFORCEMENT OFFICER

  • No report this month.

BUILDING & GROUNDS

  • A recent article was in the Livingston County News on the Caledonia Rural Cemetary and recent improvements.

HIGHWAY

  • Highway Superintendent Mark Schroeder was attending Pesticide School so Supervisor Pangrazio presented the Board with the Monthly Highway report. The Highway Department has been working on the following projects:
  1. Wedge River Road for the County
  2. General maintenance on the equipment
  3. Help the County and other Towns as needed
  4. Work on Cameron Road leveling shoulders and pulling out tree stumps
  5. Put up snow fence, and mow back where crops are off the fields
  6. Put on plow frames and got the sanders ready
  7. Paved, stone and oiled and put shoulders on Fletcher Lane
  8. Double ground brush pile
  9. Helped the village with Blacktop for part of Park Place

TOWN CLERK’S REPORT

  • Town Clerk Laurie Sattora submitted her monthly report for the month of September 2007 to the Town Board. For the month of September 2007 the total State, County and Local Revenues received in the Town Clerk’s office were $7,476.50. The total local shares were $2,671.39. $59.92 went to the County Treasurer for Dog Licenses, $9.00 went to NYS Ag & Markets for the spay/neuter program, $4,668.69 went to NYS Environmental Conservation for Licenses, and $67.50 went to NYS Department of health for Marriage Licenses.

On motion of Councilman Anderson, seconded by Councilwoman Rychlicki, the following resolution was

RESOLVED, that the Town Board accept Town Clerk Laurie Sattora’s report for September 2007.

INCREASING MAXIMUM INCOME ELIGIBILITY FOR TAX EXEMPTION FOR SENIOR CITIZENS

On motion of Councilman Rothrock, seconded by Councilman Bickford, the following resolution was

ADOPTED Aye – Pangrazio, Rothrock, Rychlicki, Anderson, Bickford Nay – 0

RESOLVED, THAT PURSUANT To Real Property Tax Law, the Town of Caledonia will adopt the following income eligibility sliding scale for property owners over the age of sixty-five (65).

ANNUAL INCOME RESIDENTIAL EXEMPTION

$0.00 - $18,500.00 50%
$18,500.01 - $19,499.99 45%
$19,500.00 - $20,499.99 40%
$20,500.00 - $21,499.99 35%
$21,500.00 - $22,399.99 30%
$22,400.00 - $23,299.99 25%
$23,300.00 - $24,199.99 20%
$24,200.00 - $25,099.99 15%
$25,100.00 - $25,999.99 10%
$26,000.00 - $26,899.99 5%

INTRODUCTION OF LOCAL LAW

Supervisor Pangrazio introduced proposed Local Law No. 3 for the year 2007. This local law would increase the maximum income eligibility for tax exemption from real property taxes to persons with disabilities who have limited income.

PUBLIC HEARING FOR PROPOSED LOCAL LAW No. 3 for the year 2007

On motion of Councilwoman Rychlicki, seconded by Councilman Anderson, the following resolution was

ADOPTED Aye- Pangrazio, Rothrock, Rychlicki, Anderson, Bickford Nay-0

RESOLVED, that a public hearing will be held November 08, 2007, at 7:15 PM, at the Town Hall for the purpose of considering proposed Local Law No. 3 for the year 2007, a local law amending Local Law No. 3 of the year 1998 increasing the maximum income eligibility for persons with disabilities who have limited income.

|TENTATIVE BUDGET – PRELIMINARY BUDGET

On motion of Councilman Anderson seconded by Councilman Bickford, the following resolution was

RESOLVED, that the Tentative Budget for 2008 be accepted as presented and become the Preliminary Budget for 2008.

PUBLIC HEARING FOR PRELIMINARY BUDGET

On motion of Councilwoman Rychlicki seconded by Councilman Rothrock, the following resolution was

WHEREAS, the Tentative Budget for 2008 has been prepared and presented to the Town Board, and

WHEREAS, the Town Board has reviewed such Tentative Budget and adopted it as the Preliminary Budget, therefore be it

RESOLVED, that the Town Board meet and review the Preliminary Budget for the year 2008 and hold a Public Hearing thereon at the Town Hall, 3109 Main Street, Caledonia, NY, at 7:30 P.M., on November 08, 2007, and that the Clerk shall give due notice of such public hearing in the manner as provided in Section 108 of Town Law.

SNOW & ICE CONTROL

On motion of Councilman Rothrock, seconded by Councilwoman Rychlicki, the following resolution was

ADOPTED Aye- Pangrazio, Rothrock, Rychlicki, Anderson, Bickford Nay- 0

RESOLVED, that pursuant to Highway Law Section 135-a providing for snow and ice control on county roads within the Town, the Supervisor and the Town Highway Superintendent be and they are directed to execute a contract with the County Highway Superintendent of the County of Livingston for the Town to undertake and perform snow and ice control on County Roads located in the Town for the period beginning October 15, 2007 and ending October 14, 2010 at the rates therein provided:

2007 – 2008 $3,600.00
2008 – 2009 $3,700.00
2009 – 2010 $3,800.00

APPOINTMENT TO ZONING BOARD OF APPEALS

On motion of Councilman Bickford, seconded by Councilwoman Rychlicki, the following resolution was

RESOLVED, that Ed Schiedel be appointed to the Zoning Board of Appeals, term ending December 31, 2008 to fill the vacancy of Russell Barber.

Supervisor Pangrazio read the letter of resignation, received from Town Court Clerk Barbara Keenan.

RESOLVED, that the resignation from Town Court Clerk Barbara Keenan be accepted with regrets and a thank you for all the years served.

RESOLVED, that the board enter into executive session for the purpose of discussing personnel.

On motion of Councilman Bickford, seconded by Councilman Anderson, the following resolution was

RESOLVED, that the Executive session be closed and the Board return to regular session with no action taken.

RESOLUTION 119-2007
PAYMENT OF BILLS

On motion of Councilman Rothrock, seconded by Councilman Bickford, the following resolution was

ADOPTED Aye- Pangrazio, Rothrock, Rychlicki, Anderson, Bickford Nay- 0 RESOLVED, that the bills be paid in the following amounts:

  • General Fund Claims 269-309 $17,529.65
  • Highway Fund Claims 137-158 $27,076.58

The Board audited the Abstract of Paid Vouchers.

The Supervisor’s Monthly Report was presented for review.

On motion of Councilman Rothrock, seconded by Councilman Bickford, the meeting was adjourned.
